which the applicant obtains a building permit and begins construction. The compliance date is <br />the date by which the development is complete. Based on the timetable for construction, staff <br />would recommend the following commencement and compliance dates: <br /> <br />Commencement Date: August 1, 2017 <br />Compliance Date: December 31, 2018 <br /> <br />Changes or extensions to the commencement or compliance dates require City Council approval. <br /> <br />Based on the above analysis, all PUD approval criteria of section 7-240 have been met. <br /> <br />PRELIMINARY PLAT ANALYSIS <br />Preliminary plat approval is being sought for the development, to be known as Lot 1, Block 1, <br />NEW BRIGHTON EXCHANGE 3RD ADDITION. <br /> <br />Section 26-32 establishes the data necessary for preliminary plat submittal and the procedures <br />under which the City shall review the plat. All required submittals were received, reviewed by <br />all departments, and found to be satisfactory. Also, all required legal notices were met. <br />Additionally, Section 26-33 establishes the following qualifications governing the preliminary <br />plat (staff responses in italics): <br /> <br />(1) The Planning Commission may return a conditional recommendation. The City Council may <br />require revisions as it deems necessary for the health, safety, general welfare, order and <br />convenience of the City. <br /> <br />Staff would recommend a condition of approval related to the County Surveyor’s review. <br /> <br />(2) The approval of a preliminary plat indicates that the subdivider may proceed toward fulfilling <br />the necessary steps for approval of the final plat in accordance with the terms of approval. <br /> <br />Final plat approval will run simultaneously with the Preliminary Plat (see Final Plat analysis <br />section of report). <br /> <br />(3) No plat will be approved for a subdivision which covers an area subject to periodic flooding <br />or which contains extremely poor drainage facilities and which would make adequate drainage of <br />the streets and lots impossible. <br /> <br />There are no flood impacted areas within the preliminary plat. <br /> <br />The preliminary plat will create one new lot and block (to be developed by Ryan Companies for <br />TUV SUD) and Outlot A to be retained by the City. The lot breakdown is as follows: <br /> <br />Lot 1, Block 1: 182,477 SF (4.19acres) <br />Outlot A: 415,261 SF (9.53 acres) <br />Total Plat Area: 597,738 SF (13.72 acres) <br /> <br />Staff finds the plat to be in satisfactory form, including the dedication of the appropriate <br />easements. Outlot A will be retained by the City for drainage and future development of <br />parkland and/or roadways.
