7. The proposed plan includes construction of a 11,200 SF two-story office building <br />including associated surface parking, lighting, landscaping, utility, drainage, and <br />other related site improvements. <br />8. The Planning Commission has considered the Rezoning request consistent with the <br />requirements of Article 3 of Chapter 8 of the Zoning Code. <br />9. The Planning Commission is recommending approval of the Rezoning based on the <br />following findings: <br />a. The applicant has furnished the required petition with six signatures. <br />b. Proper notice of the rezoning request has been provided. <br />c. The parcel has been vacant for years, and while a low density residential <br />subdivision concept has been drafted, it has shown to not be marketable given it <br />has not been implemented in the past eight years. <br />d. There are three other parcels along Cleveland Avenue SW that are zoned B-1, <br />Limited Business has have shown to be compatible with surrounding land uses. <br />e. The property has a history of a commercial presence, with Rick’s Roofing <br />operating out of the parcel for years, including use of outdoor storage. <br />10. The Planning Commission has considered the Comprehensive Plan Amendment <br />request in accordance with the requirements of Minnesota Statutes 462.355. <br />11. The Planning Commission is recommending approval of the Comprehensive Plan <br />Amendment request based on the following findings: <br />a. Proper notice of the request to amend the Comprehensive Plan has been provided. <br />b. The LB, Limited Business guide plan designation will ensure consistency with the <br />City’s official Zoning Map. <br />12. The applicant has requested Site Plan approval and the Planning Commission has <br />reviewed the Site Plan against all criteria within Chapter 5, Chapter 8, and Chapter 11 <br />of the Zoning Code. <br />13. The Planning Commission has determined all Site Plan criteria have been met, <br />including compliance with building setbacks, parking setbacks, building height, floor <br />area ratio, off-street parking, screening, exterior building materials, and landscaping. <br /> <br />NOW THEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the <br />application for a Rezoning (PR17-0001), Comprehensive Plan Amendment <br />(PCPA17-0001), and Site Plan (PSP17-0002) are hereby recommended to the City <br />Council for approval, subject to the following conditions: <br />1. Development of the property consistent with the plans attached to the Planning <br />Report dated 6/15/2017, unless otherwise noted for revision herein. <br />2. The requested Minor Subdivision is approved by the City Council. <br />3. Ramsey County approval of the new driveway access point to Cleveland Avenue. <br />4. Submittal of an approved Rice Creek Watershed District permit, should one be <br />required. <br />5. Adjacent communities and school districts shall be provided 60 days to review the <br />request, unless a waiver is allowed by the Metropolitan Council. If a waiver is not <br />provided, the City Council shall not take final action until after the 60 days has <br />elapsed. <br />6. Metropolitan Council approval of the Comprehensive Plan Amendment. <br />7. The Landscape Plan shall be revised whereby all trees are moved west outside the <br />roadway easement area.
