RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A REZONING, <br />COMPREHENSIVE PLAN AMENDMENT, AND SITE PLAN FOR THE NORTHERN ONE ACRE OF <br />256 CLEVELAND AVENUE SW. <br /> <br />WHEREAS, an application has been made by Mitch and Ramona Erickson on behalf of <br />Provident Home Health Care for a Rezoning, Comprehensive Plan Amendment, and Site <br />Plan for development of the northern one acre of 256 Cleveland Avenue SW within an <br />11,200 SF office building and associated surface parking, landscaping, lighting and utility <br />improvements, including retention of the existing single family home. <br /> <br />WHEREAS, the procedural history of the applications are as follows: <br />1. Applications for a Rezoning, Comprehensive Plan Amendment, and Site Plan were <br />received on May 25, 2017. <br />2. Public hearing notices for the requests were published in the New Brighton Bulletin <br />on June 7, 2017. <br />3. Public hearing notifications were mailed to all property owners within 350’ of the <br />subject property on June 9, 2017. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on June 20, 2017. <br />5. The Planning Commission recommended conditional approval of the requests on June <br />20, 2017. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to <br />the Rezoning (PR17-0001), Comprehensive Plan Amendment (PCPA17-0001), and Site <br />Plan (PSP17-0002): 1. The property is currently zoned R-1, Single Family Residential. <br />2. The property is currently guided in the New Brighton Comprehensive Plan for LDR, <br />Low Density Residential. <br />3. The property is proposed to be rezoned to B-1, Limited Business. <br />4. The property is proposed to be re-guided in the New Brighton Comprehensive Plan <br />for LB, Limited Business. <br />5. The applicant has made a concurrent application for a Minor Subdivision, subdividing <br />off the southern 0.4 acres of land for retention of the existing single family homes, <br />including removal of one of the larger detached garages and relocating the barn to <br />meet minimum accessory structure setbacks. <br />6. The property to be rezoned to B-1 and re-guided in New Brighton’s Comprehensive <br />Plan for LB, Limited Business is legally described as follows: <br />The North 10 acres of the Southeast Quarter of the Northeast Quarter of Section 32, <br />Township 30 North, Range 23 West lying Easterly of the Easterly right of way line of <br />Interstate Highway No. 35W and subject to the right of way of Cleveland Avenue <br />S.W. over the East 33 feet thereof, Ramsey County, Minnesota EXCEPT the South <br />93 feet thereof.
