<br /> <br />6 <br /> <br />(B) The City of New Brighton requests consideration of a Zoning Code Amendment to Article 4 of <br />Chapter 8 of the Zoning Code, clarifying and defining expansion of a nonconforming use. <br /> <br />Planning Director Janice Gundlach reported City staff is initiating an amendment to the City’s Zoning Code, <br />Article 4 of Chapter 8, concerning nonconforming uses. The proposed amendment aims to clarify an existing <br />interpretation that nonconforming uses cannot be expanded. While the current language of Article 4, Chapter 8 is <br />clear that nonconforming uses, buildings and structures cannot be expanded, the proposed amendment aims to more <br />clearly articulate what is included in a use expansion. The reason for this amendment arose out of a request for a <br />Zoning Compliance letter for a legal, nonconforming trucking operation at 50 14th ST NW. This property recently <br />changed ownership and the City wanted to clarify what is permitted of a nonconforming use. The drafting of this <br />amendment was communicated to the entity who requested the Zoning Compliance letter. Staff recommends the <br />Planning Commission recommend the City Council adopt the Zoning Code amendment as drafted. <br /> <br />Commissioner Fynewever appreciated the fact that an inquiry to the City turned into action. <br /> <br />Motion by Commissioner Murphy, seconded by Commissioner Frischman to close the Public Hearing. <br /> <br />Approved 6-0. <br /> <br />Commissioner Frischman stated she appreciated the clear language being proposed by City staff within the <br />proposed Zoning Code amendment. <br /> <br />Chair Nichols-Matkaiti questioned if the number of employees could change if the ownership of the business <br />were to change. Planning Director Gundlach stated this would be difficult for the City to enforce unless the <br />number increased so drastically that traffic and noise became a concern. <br /> <br />Motion by Commissioner Danger, seconded by Commissioner Murphy, to approve staff <br />recommendation. <br /> <br />Approved 6-0. <br /> <br /> <br />Other Business: None. <br /> <br /> <br />Adjournment: <br /> <br />Motion by Commissioner Frischman, seconded by Commissioner Fynewever, to adjourn the meeting. <br /> <br />6 Ayes, 0 Nayes, Motion carried. <br /> <br />Meeting adjourned at 8:48 PM <br /> <br />Respectfully submitted, <br /> <br /> <br />Janice Gundlach <br />Assistant Director of Community Assets and Development/Director of Planning
