Comprehensive Plan Designation: LI, Light Industrial <br />Zoning: I – 1, Light Industrial <br />Surrounding Land Uses: <br /> North: industrial uses <br /> South: industrial uses <br /> East: industrial uses <br /> West: Old Highway 8 NW, Long Lake Regional Park <br /> <br /> <br />SPECIAL USE PERMIT ANALYSIS <br />Chapter 6, Article 1, I – 1, Light Industrial District does not list indoor fitness facilities as uses <br />allowed in the district. However, Section 6-050 (2) states that the City Council may permit any <br />use in an industrial district by means of a Special Use Permit (except residential and heavy <br />industrial uses) subject to review of the standards in Section 8-130. <br /> <br />Zoning Code Section 8-130 states that no special use shall be recommended by the Planning <br />Commission unless it shall find (staff responses in italics): <br /> <br />(1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br /> <br />Staff finds this criterion to be met. The applicant’s proposed use of the industrial space for <br />indoor fitness is not a use that will be a detriment to or endanger the public health, safety, <br />morals, comfort or general welfare. Public Safety has reviewed the applicant’s floor plan and <br />recommends the applicant ensure access to an AED device for the safety of their customers. <br /> <br />(2) That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br /> <br />Staff finds this criterion to be met. The applicant will utilize existing industrial space with a <br />business that will not be injurious to the use or enjoyment of adjacent users or the immediate <br />neighborhood. In fact, the applicant’s proposed use of the space may have less noise and traffic <br />impacts that the current user. <br /> <br />(3) That the establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br /> <br />Staff finds this criterion to be met. The space the applicant intends to occupy is fully developed <br />and occupancy of the space for indoor fitness should not impede any other development or <br />improvements that may be planned for the property or surrounding property. <br /> <br />(4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br /> <br />Staff finds this criterion to be met.
