Discussion included: <br />• Staff noted the floodplain data used for this property was from 2010. <br />Tim Miller, 1244 Long Lake Road, introduced himself to the Commission and explained he was <br />requesting the additional garage space as this would allow him to store his boat and trailer <br />indoors. He reported he had a driveway already in place that would provide access to the new <br />garage. <br />Andra Storla, 1248 Long Lake Road, reported she has lived at her home for the past 20 years and <br />has always enjoyed living in New Brighton. She explained she works in the Mounds View <br />Public School system and noted this was a very important issue to her. She indicated she was <br />concerned with her lake view being impacted by the proposed new garage. She questioned if the <br />large garage should be approved for a rental property operating as a duplex. She requested staff <br />investigate if the property had a proper rental license and noted a Special Use Permit could only <br />be granted if the property was in compliance with City Code. She reviewed pictures of how her <br />lake view would be impacted with the Commission and encouraged them to not support the <br />requested Special Use Permit. <br />Motion by Commissioner Miwa, seconded by Commissioner Murphy to close the Public <br />Hearing. <br />Approved 5-0. <br />Gundlach reported all other zoning requirements must be met in order for a Special Use Permit <br />to be approved. She understood that the property was a rental, which was allowed under City <br />Code and a license wasn't required. She explained she was not aware the property was a duplex <br />and if this the case, this would be illegal and would be a problem. However, staff would have to <br />investigate further if it was operating as a duplex. She stated she thought the property only had <br />one water bill but was uncertain how many electric bills were being sent to this address. She <br />commented on the City's Shoreland Ordinance and the average lakeshore setback language not <br />being included. She explained this language was drafted to preserve view sheds for lakeshore <br />properties and was originally introduced many years ago, but not supported by the community or <br />Council at that time. <br />Chairperson Nichol s-Matkaiti requested comment from the applicant regarding the status of his <br />property. <br />Mr. Miller explained Ms. Storla lives three or so homes away from the lake and her view of the <br />lake was blocked by greenery for the majority of the year. He indicated he purchased this home <br />16 years ago and noted he lived on site for a time, but has since moved. He stated he has rented <br />out the lower level over the years, and now rents out both levels. He commented the property <br />has one electrical service, one mailbox and one water bill. <br />Commissioner Frischman indicated the home was originally purchased as a single-family home <br />and asked when the mother-in-law or lower level apartment was completed. Mr. Miller <br />explained the lower level apartment was already in place when he purchased the home and he <br />simply renovated it. <br />ki <br />
