Commissioner Fynewever inquired if the lower level unit had a separate entrance when he <br />purchased the home. Mr. Miller stated this was already in place. <br />Commissioner Miwa asked how many unrelated adults were currently living in the home. Mr. <br />Miller indicated there were five, soon to be four adults. <br />Commissioner Miwa stated this was a problem and for this reason, she was not comfortable <br />moving forward with a Special Use Permit for the property at 1244 Long Lake Road. <br />Commissioner Fynewever questioned if the proposed garage would have daily use. Mr. Miller <br />stated he would be the only person using the proposed garage for the storage of his boat and <br />trailers. <br />Commissioner Miwa asked why the garage was being proposed for this property versus where <br />Mr. Miller currently lives. Mr. Miller stated he could not build a garage of this size on the <br />property he lives at. <br />Chair Nichols-Matkaiti understood the view was important but feared the garage was meeting all <br />City requirements. She explained her bigger concern was with Item E and if the property was <br />currently meeting all City requirements. Gundlach stated she did not know if this was a legal <br />duplex or when it was converted from a single-family home to a duplex. She anticipated this <br />would be really difficult to determine. However, she commented that no more than four <br />unrelated adults could be living on the property and he said there was five. This violated the <br />requirements within the single family residential district. She reported this item has been <br />delayed since July and the applicant has extended the request to February. She indicated the <br />applicant would have to provide staff with a written request to allow provide the City with more <br />time to resolve the issue. Otherwise, the Commission could proceed with a denial request. <br />Chair Nichols-Matkaiti questioned how much of an extension would be needed from the <br />applicant. Gundlach recommended the extension be extended to March 28'n <br />Commissioner Fynewever asked if the applicant had considered other locations on the lot for the <br />garage. Mr. Miller explained the proposed location would allow him to maneuver in and out <br />with a boat and trailer, while other locations would not accommodate this action. <br />Commissioner Fynewever inquired what information could be gathered if the matter were <br />extended. Gundlach stated staff could investigate the "duplex" classification of the property and <br />cite the property owner for having five unrelated adults within the home, given the fact he stated <br />this fact on camera during a public meeting. She wanted to speak with the City Attorney and <br />noted staff could then report back to the Commission in March with further details on the <br />condition of the property. <br />Commissioner Miwa questioned if it was within the Commission's authority to table the request <br />given the fact the matter has already been extended. Gundlach recommended the item only be <br />tabled if the applicant provides staff with a handwritten request at this time to extend the item to <br />March 28t". She noted the item could proceed to the City Council next week absent a <br />recommendation from the Planning Commission. <br />M <br />
