Commissioner Fynewever stated she did not need to continue action on this item if the item <br />would be denied in the end. <br />Commissioner Miwa commented if the item were tabled for a month, one of the five individuals <br />would be leaving which would resolve the issue at hand. This would then allow the Commission <br />to address the request as the property would be in conformance with City Code requirements. <br />Commissioner Frischman questioned how the City could confirm the number of individuals <br />living in the home. Gundlach stated the Commission would have to take the word of the <br />applicant but noted the City Attorney could be brought in to request rental agreements to try and <br />confirm the number of individuals living in the duplex. <br />Gundlach reported for the record the applicant had provided her with a hand-written extension to <br />April 15, 2018. She explained this would allow staff an adequate amount of time to review the <br />outstanding issues. She asked if the Commission had any other concerns or comments that <br />should be addressed by staff. <br />Commissioner Fynewever stated she wanted to be sure the applicant followed all Rice Creek <br />Watershed requirements as well. <br />Commissioner Murphy suggested staff consider landscaping or screening around the garage. <br />Commissioner Miwa asked if a second Special Use Permit fee would be paid by the applicant for <br />the fill. Gundlach explained she and the applicant disagreed on this item. She believed a second <br />fee was due to the City given the fact the fill is only allowed by Special Use Permit. She <br />reported the applicant owed the City an additional $370 for the additional Special Use Permit <br />request. <br />Chairperson Nichols-Matkaiti thanked the Commissioners for their input on this item and <br />requested a motion to table action on this item. <br />Motion by Commissioner Fynewever, seconded by Commissioner Miwa, to table action on <br />this item to the March 20, 2018 Planning Commission meeting to allow staff time to <br />confirm compliance with City Code's single-family definition. <br />Approved 5-0. <br />VII. Business Items <br />Gundlach reported staff was working on the Comprehensive Plan and noted the Commission would be <br />reviewing this item in March or April of 2018. <br />VIII. Adjournment <br />Motion by Commissioner Frischman, seconded by Commissioner Murphy, to adjourn the <br />meeting. <br />5 Ayes, 0 Nayes, Motion carried. <br />
