Planning Director Gundlach reported the City did not have survey information to clarify the exact <br />location of Ms. Storla's home. She commented it was not uncommon for homes on a lake to be <br />oriented not in alignment of the property lines. <br />Commissioner Fynewever thanked Mr. Miller for his service on the United States military. She <br />explained the Planning Commission was bound by City requirements when reviewing this request. <br />Mr. Miller clarified that he would not consider his home to be on the lake, but rather had a view of the <br />lake. <br />Commissioner Frischman asked if the reason the garage could not be relocated was because it would <br />cause a visual hardship to the applicant. Mr. Miller stated there was more to it than just losing the view <br />of the lake. He explained if the garage were located outside of the floodplain it would be extremely <br />difficult for him to maneuver in and out of the garage space. <br />Commissioner Frischman questioned if Mr. Miller would be moving forward with the garage if it had to <br />be located outside of the l 00 -year floodplain. Mr. Miller stated he would not be pursuing the proposed <br />garage if this were the case. He indicated this would not be reasonable. He explained his neighbor <br />would still have a view of her entire yard. <br />Motion by Commissioner Murphy, seconded by Commissioner Fynewever to close the Public <br />Hearing. <br />Approved 5-0. <br />Discussion included: <br />• The Commission discussed allowing a property owner the right to build on their property if <br />following all City standards. <br />• Commissioner Fynewever stated the only way she could not support this request was if she was <br />advocating for a change to the Shoreland Ordinance setback. <br />• Commissioner Frischman expressed concern with how the City was defining commercial <br />purposes with regard to the proposed garage and questioned if the term income generating should <br />be included. Planning Director Gundlach stated she could reword Condition #6 to address this <br />concern. She suggested Condition #6 read: The detached garage shall not be used for an illegal <br />home occupation as defined in Zoning Code Section 4-550 and shall only be used for personal <br />storage of the property owner and/or use by tenants of the home. The Commission supported <br />this change. <br />• Staff recommended the affidavit be attached to the Resolution as Exhibit A. She suggested <br />Condition #7 read: The property continues to comply with the statements made in the affidavit, <br />attached as Exhibit A, provided by the applicant, signed and dated March 5, 2018. <br />• The Commission asked if the garage could have a flat roof. Mr. Miller indicated a flat roof <br />would be more difficult to maintain and would limit the amount he could store in his garage. In <br />addition, he believed a truss system with a pitched roof would provide him with a stronger <br />building. Planning Director Gundlach reviewed City Code Section 4-530 stating the roof and <br />exterior building materials were to match the principal structure. She noted a flat roof would not <br />match the existing home. <br />5 <br />
