<br /> <br />2 <br /> <br />commented further on the great work being completed by CPY and invited the public to attend their <br />upcoming Game Night fundraiser on Monday, October 22nd at the New Brighton Community Center. <br />She explained the Council met last week in a worksession meeting to discuss the 2019 budget. <br />VI. Public Hearing <br />(A) MINOR SUBDIVISION, SPECIAL USE PERMIT AND SITE PLAN REVIEW: A request from NROCK <br />Properties, LLC and RLNB Properties LLC to create a new lot with easements on the western <br />third of the property located at 2350 Palmer Drive to allow for construction of a new dental <br />clinic with retail space – PID 19-30-23-43-0039. <br /> <br />City Planner Gozola reported Dr. David Ong, owner of Silver Lake Smiles currently located at 1125 Silver <br />Lake Road, is seeking approval to construct a new building for his practice to the west of The Garage <br />located at 2350 Palmer Drive. The project includes a minor subdivision of the existing land, and <br />construction of a new 3,168 SF building. As allowed via SUP in the Palmer Overlay District, the building <br />is proposed to be closer to the road than 30 feet. The dental practice would fill 60% of the building <br />following construction, with the remaining 40% reserved for a different tenant or eventual expansion <br />of the dental practice. Staff recommends approval of all requests subject to the following findings of <br />fact and conditions: <br />FINDINGS OF FACT: <br />1. The subject site is guided for community business by the comprehensive plan, and <br />professional service occupations (including dentist offices) are an allowed use within the B-3 <br />zoning district. <br />2. The proposed subdivision will not result in any nonconformities for the existing use (The <br />Garage). <br />3. The existing and proposed buildings will be conforming to floor area ratio standards <br />applicable to each lot. <br />4. A geotechnical analysis of the site provided by the applicant shows the land is suitable for the <br />proposed construction. <br />5. Proposed improvements to landscaping and lighting will be conforming to the underlying <br />zoning (B-3) and/or Palmer Overlay District standards. <br />6. The site can be serviced by public utilities provided all engineering conditions are addressed. <br />7. Parking on both resulting sites will be conforming to code requirements. <br />8. The proposed location of the new building will not endanger the public health or general <br />welfare. <br />9. The new building will not impair area property values. <br />10. The new building will not impact development on surrounding properties. <br /> <br /> <br />
