REQUEST FOR CITY COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Consideration of a Resolution approving Special Use Permits for <br />Tim Miller, 1244 Long Lake Road. <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets <br />& Development <br />CITY MANAGER APPROVAL: <br />No comments to supplement this report _______ Comments attached ______ <br />15.99 Deadline: April 15, 2018 (extended multiple times by the applicant) <br />Recommendation: Adopt the attached Resolution approving the requests, subject to seven <br />conditions. <br />Legislative History: March 20, 2018: The Planning Commission continued discussion on the <br />requests and revised the updated information provided by City staff. The Commission also took <br />additional public testimony by the applicant and neighbor to making a determination if there was <br />a revised location for the garage that could satisfy both parties. The Commission made a motion <br />to approve the staff recommendation, with revisions to conditions six and seven, which was <br />approved unanimously. <br />February 20, 2018: The Planning Commission considered the request and held a public hearing. <br />The neighbor to the north testified during the hearing the placement of the detached garage would <br />block views of the channel and lake she currently enjoys across the applicant’s property. The <br />applicant provided testimony that he positioned the garage in the location that took into <br />consideration his neighbor’s concerns, but also provided him the necessary maneuvering space he <br />needed to store his boat and trailer. The neighbor provided further testimony the home was being <br />used as an illegal duplex. Based on this claim, and information provided by the applicant, the <br />request was tabled to allow staff and the applicant the necessary time to determine if and how the <br />duplex claim could be resolved. <br />Financial Impact: None <br />Explanation: The applicant is requesting the following land use approvals in order to facilitate <br />construction of a detached garage in the rear yard (abutting the channel connecting Pike Lake and <br />Long Lake), measuring 26’ x 36’ or 936 SF: <br />AGENDA SECTION: Consent <br />REPORT DATE: 3/21/2018 <br />MEETING DATE: 3/27/2018
