I:\Council - NEW FOLDER\2018\Report Drafts and Working Documents\Community Dev and Assets\Planning & Economic <br />Development\05.22.2018\big blue box SUP\RESOLUTION.doc 1 <br />RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br /> <br />WHEREAS, an application has been made by Voyd Trailer of MN, LLC dba Big Blue Boxes to <br />permit operation of trailer sales located at 565 1st Street SW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on April 18, 2018. <br />2. A public hearing notice was published in the May 2, 2018 edition of the New Brighton <br />Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on May 2, 2018. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 15, 2018 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission voted to recommend conditional approval on May 15, 2018. <br />6. The City Council considered the request on May 22, 2018. <br /> <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (PSCI18-003): <br />1. The property is zoned I – 2, Heavy Industrial. <br />2. The property is guided in the Comprehensive Plan for HI, Heavy Industrial. <br />3. The property is legally described as follows: <br />Certificate of Title No. 572241: <br />That part of the Northwest quarter of the Northeast quarter of Section 32, Township 30, <br />Range 23, lying westerly of Minnesota Transfer Railway Company’s right-of-way, southerly <br />of the center line of First Street Southwest and easterly of the West 899 feet, except the North <br />169.80 feet of the West 17.00 feet thereof. <br />4. The applicant is proposing to be allowed to keep one to five trailers on site for sale. <br />5. Zoning Code Sections 6-140 indicates a Special Use Permit is required for vehicles and <br />truck/trailer sales. <br />6. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Special Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district.
