That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />6. The Planning Commission and City Council found all Special Use Permit criteria of Section <br />8-130 to be met due to the following: <br />a. Keeping one to five trailers on site for sale will not be readily noticeable based upon the <br />applicant’s primary business of renting and storage intermodal storage containers/trailers. <br />b. The applicant’s Site Plan appropriately depicts the location of the for-sale trailers, which <br />will not be readily visible from the roadway. <br />c. The applicant will not keep any damaged, inoperable, unlicensed, or salvaged trailers on <br />the property for sale. <br />d. The use would be consistent with other heavy industrial uses in the neighborhood that <br />utilize outdoor storage. <br />e. The applicant is in compliance with the development plans from 2016. <br /> <br />NOW THEREFORE BE IT RESOLVED that based upon the above findings of fact the application <br />for a Special Use Permit (PSCI18-003) is hereby approved, subject to the following <br />conditions: <br />1. The trailers sales are conducted consistent with the representations made within the <br />Planning Report dated May 15, 2018 and the updated Site Plan dated 5/15/2018. <br />2. The applicant is limited to one to five trailers for-sale to be kept on the property at any <br />given time. <br />3. No damaged, inoperable, unlicensed, or salvaged trailers may be kept on the property. <br /> <br />ADOPTED this 22nd day of May 2018, by the New Brighton City Council with a vote of __ ayes <br />and __ nays. <br /> <br /> <br /> <br /> Valerie Johnson, Mayor <br /> <br /> <br /> <br /> <br />ATTEST: <br /> <br /> <br /> Dean R.
