Consider Resolution Confirming Polling Places. <br /> <br />Motion by Councilmember Allen, seconded by Councilmember Jacobsen to approve the Consent <br />Agenda as presented. <br /> <br />Councilmember Jacobsen stated he was pleased the City was always looking for ways to save the City <br />money. He commented further on the G.O. Bonds that would be retired. <br /> <br />4 Ayes, 0 Nays - Motion Carried <br /> <br />Public Hearing <br /> <br />None. <br /> <br />Council Business <br />1. Ordinance 863: <br />a. Consider Approval of Ordinance 863 to update Zoning Code Variance Provisions and <br />Consider Approval of a Resolution authorizing Summary Publication for Ordinance 963. <br /> <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt Ordinance 963, an <br />Ordinance to update the Definition of “Variance” and associated Variance provisions to be in <br />compliance with Current State Statutes. <br /> <br />City Manager Lotter indicated Assistant Director of Community Assets and Development Gozola would be <br />presenting this item to the Council. <br />Assistant Director of Community Assets and Development Gozola explained both staff and the Planning <br />Commission are recommending approval of the amended Ordinance language to update the City’s variance <br />regulations. He stated around 2010, a combination of legal decisions and actions by the State <br />Legislature required that all communities within the State of Minnesota update its process to <br />issue variances to zoning provisions. While the City of New Brighton did update its ordinance <br />at the time, it neglected to amend the definition of “variance” within zoning which still <br />references the old “hardship” rules that were in place prior to 2010. This ordinance will correct <br />that oversight, and will clarify the present language in code relating to the processing and <br />issuance of variances. He reported the Planning Commission reviewed this language in <br />October and recommended adoption of the Ordinance. <br />Councilmember Burg requested further information regarding second family dwellings. <br />Assistant Director of Community Assets and Development Gozola commented on the City’s requirements <br />regarding second family dwellings. <br /> <br />4 Ayes, 0 Nays-Motion Carried <br /> <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt a Resolution <br />Authorizing Publication of Ordinance No. 863 by Title and Summary. <br /> <br />4 Ayes, 0 Nays-Motion Carried <br /> <br />Commission Liaison Reports, Announcements and Updates <br /> <br />Dean Lotter <br />City Manager Lotter updated the Council on the Parks Department’s strategic planning <br />process.
