PLANNING REPORT <br /> <br />DATE: February 20, 2018 <br />CASE: PSR170002 <br />SUBJECT: Special Use Permit to Construct a Detached Garage Larger than 624 SF & <br />a Special Use Permit to Alter the Floodplain <br />APPLICANT: Tim Miller <br /> <br />REQUEST & BACKGROUND <br />The applicant is requesting the following land use approvals in order to facilitate construction of <br />a detached garage in the rear yard (abutting the channel connecting Pike Lake and Long Lake), <br />measuring 26’ x 36’ or 936 SF: <br />• Special Use Permit: Required per Zoning Code Section 4-530 (K) for detached garages <br />in excess of 624 SF up to 1,064 SF, and <br />• Special Use Permit: Required per Zoning Code Section 10-040 (3) to place fill and/or <br />structures within the floodway. <br /> <br />The applicant originally requested a Special Use Permit for the detached garage in excess of 624 <br />SF in July of 2017. Once the applicant submitted the required plans, it became apparent the <br />proposed garage would be impacted by the 100 year floodplain, as it was located within an <br />elevation of 872 (the floodplain elevation designated by FEMA). The applicant was notified via <br />letter on 8/10/2017 that his application was incomplete and additional materials would need to be <br />submitted to determine compliance with floodplain regulations, namely a grading plan. <br /> <br />Since then the applicant has been working with the Rice Creek Watershed District (RCWD) and <br />City staff to determine how to meet floodplain criteria. In an email dated October 26, 2017, the <br />applicant requested until February 28, 2018 to submit the necessary materials and appear before <br />the Planning Commission and City Council. On February 5, 2018, the applicant submitted plans <br />meetings RCWD rules and the City’s Floodplain Ordinance (Chapter 10).
