1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL SPECIAL USE PERMITS. <br /> <br />WHEREAS, an application has been made by Tim Miller to permit construction of a new detached <br />garage whereby the total square footage would exceed 624 s.f. at approximately 936 SF and to <br />permit floodplain alterations at 1244 Long Lake Road, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on July 19, 2017. <br />2. The applicant was deemed incomplete via a written letter dated August 10, 2017. <br />3. The applicant communicated via email on October 26, 2017 that more time was requested in <br />order to submit the necessary materials to accomplish a complete application and requested <br />an extension to February 28, 2018. <br />4. The applicant submitted required materials on February 5, 2018. <br />5. A public hearing notice was published in the New Brighton Bulletin on February 7, 2018. <br />6. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on February 8, 2018. <br />7. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on February 20, 2018 where all interested parties were heard. <br />8. The Planning Commission recommended approval on February 20, 2018. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (PSR17-0002): <br />1. The property is located at 1244 Long Lake Road. <br />2. The property is zoned R-1, Single Family Residential. <br />3. The property is guided in the Comprehensive Plan for Low Density Residential. <br />4. The property is legally described as follows: <br />Warranty Deed Doc. No. 3556534 <br />All that part of the Northwest ¼ of the Southwest ¼ of Section 20, Township 30, Range 23, <br />described as follows: Beginning at a point on the centerline of Long Lake Road distant <br />823.84 feet measured along said centerline South from the intersection of said centerline with <br />the North line of said Northwest ¼ of the Southwest ¼; thence West 384.56 feet, more or <br />less, to the centerline of County Ditch No. 2; thence Northeast on the centerline of said <br />County Ditch No. 2 to the South line of the North 698.65 feet of said Northwest ¼ of <br />Southwest ¼; thence East parallel to the North line of said Northwest ¼ of Southwest ¼, <br />323.47 feet, more or less, to the centerline of Long Lake Road; thence Southeast on said road <br />centerline 100 feet, more or less, to the point of beginning. Subject to Long Lake Road. <br />5. The applicant proposes to construct a new detached garage in the rear yard whereby the total <br />square footage will exceed 624 SF at 936 SF or measure 26’ x 36’ in dimension. <br />6. The applicant proposes to elevate the detached garage on approximately 50 cubic yards of fill <br />so as to elevate the garage above the floodplain elevation of 872 and to provide
