1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL A SPECIAL USE PERMIT <br />AND NONCONFORMING USE PERMIT. <br /> <br />WHEREAS, an application has been made by John Bona to allow vehicle sales at 327B Old <br />Highway 8 NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Special Use Permit and Nonconforming Use Permit were received on <br />February 28, 2018. <br />2. A public hearing notice concerning the request was published in the April 4, 2018 edition of <br />the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the property on April <br />6, 2016. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on April 17, 2018 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended conditional approval on April 17, 2018. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (PSCI18-0001) and Nonconforming Use Permit (PNCU18-0001): <br />1. The property is zoned I – 1, Light Industrial. <br />2. The property is guided in the Comprehensive Plan for BP, Business Park. <br />3. The proposed improvements are located on 327B Old Highway 8 NW. <br />4. The property is legally described as follows: <br />327 Old Highway 8 NW (293023420015) <br />The North 200.00 feet of the South 300.00 feet of the West 529.5 feet of the Northwest <br />Quarter of the Southeast Quarter of Section 29, Township 30, Range 23, Ramsey County <br />MN. <br />Together with a perpetual roadway easement over and upon the southerly 15.00 feet of the <br />westerly 194.5 feet of said North 160.00 feet of the South 460.00 feet of the westerly 529.5 <br />feet of said Northwest Quarter of the Southeast Quarter of Section 29, Township 30, Range <br />23 as created by deed recorded in Book 1481 of Deeds, page 327, and situate in Ramsey <br />County, MN. <br />5. The site is currently used for truck and trailer repair. <br />6. The applicant is proposing to open a vehicle sales operation out of the existing building <br />located at the northeast corner of the property, limited to six vehicles. <br />7. The Planning Commission considered the following special use permit criteria of Zoning <br />Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare.
