Special Use Permit Criteria Worksheet <br /> <br />A special use permit cannot be approved unless the Planning Commission and City Council find that the <br />following criteria have been met. Please provide a response on how/why your project meets the below <br />stated criteria. Use additional sheets if necessary and consult with the Planning Director at the time of <br />your Pre-Application Meeting as some items may not be applicable for your project. <br /> <br />1) That the establishment, maintenance, or operations of the special use will not be detrimental to or <br />endanger the public health, safety, morals, comfort or general welfare. <br />Highview Middle School is an existing school facility that is a specially permitted use within the <br />City of New Brighton. The construction project being proposed will look to improve the traffic <br />flow of vehicles on the site and provide a safer environment for students. The main goal for this <br />project is to reconfigure and separate the school bus traffic from the passenger car traffic. This <br />physical separation in vehicles will reduce congestion on the site as well as provide a safer <br />environment for students, as discussed. The site improvements will not endanger the public <br />health, safety, morals, comfort, or welfare of the community. <br /> <br />2) That the special use will not be injurious to the use and enjoyment of other property in the immediate <br />vicinity for the purposes already permitted, not substantially diminish and impair property values <br />within the neighborhood. <br />The new improvements to the school grounds will include the removal and replacement of <br />existing concrete curbs, drive lanes, and parking lots. As stated, the proposed project will <br />provide a reconfiguration of these facilities that will provide a safer means for the daily users. <br />The existing school building and the associated site amenities such as open field space and <br />athletic track will not be altered. With these improvements the adjacent residences and <br />neighborhood will not see impairment to their property values. <br /> <br />3) That the establishment of the special use will not impede the normal and orderly development and <br />improvement of the surrounding property for uses permitted in the district. <br />The surrounding properties adjacent to Highview Middle School are fully developed residential <br />neighborhoods. The proposed surface improvements to the school’s parking lots and drive lanes <br />should not have any effect on the development and improvement of the surrounding property. <br /> <br />4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />The existing Highview Middle School site currently has three driveway curb-cuts that are all <br />accessed from 7th Street. To improve upon the traffic congestion on the school’s property and <br />on 7th Street, it is being proposed to eliminate one driveway access. Doing as such will allow <br />vehicles to enter and exit the site with better traffic flow. <br /> <br />Additionally, a stormwater management and erosion control application has been submitted to <br />the Rice Creek Watershed District and must be approved prior to constructing the <br />improvements. The school’s site is located within the watershed’s Flood Management Zone and <br />the school is required to reduce runoff rates so they do not exceed 80% of the existing rates. <br /> <br />5) That the special use shall in all other respects conform to the applicable regulations of the district in <br />which it is located.
