Minor Subdivision, SUP, and Site Plan Review; Silver Lake Smile <br />Planning Commission Report; 8-21-18 <br /> <br /> <br />Page 12 <br />SUP Standards <br />Review: <br /> <br /> <br /> <br /> <br /> <br /> <br />Issuance of an SUP requires an analysis of the proposed use against the specific review <br />criteria established in code. Staff has reviewed the City’s criteria for special use <br />permits, and we offer the following analysis for consideration: <br /> <br />General review Criteria (Section 8-130): <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />Staff Comment : The proposed building location will not endanger the public or <br />impact general welfare. The false wall location will not encroach into the <br />sidewalk area, and there will still be adequate room for snow storage during the <br />winter months. Criteria met. <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />Staff Comment : The architecture of the new building should enhance the area and <br />will not impact the use on adjacent lands. In general, investments like this tend to <br />have a positive economic impact on surrounding properties. Criteria met. <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />Staff Comment : The Palmer Overlay District specifically provides the <br />opportunity for buildings to be closer to the road than 30 feet, and the footprint as <br />proposed will not impact surrounding redevelopment should such occur. Criteria <br />met. <br />4. That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />Staff Comment : While the Engineering memo dated 8/7/18 has a number of <br />conditions that must be met including working with MnDOLI on connection <br />issues, no issues were identified that would preclude the proposed development. <br />Criteria met. <br />5. That the special use shall in all other respects conform to the applicable <br />regulations of the district in which it is located. <br />Staff Comment : The plans as drawn up appear to meet all other requirements of <br />the B-3 zoning district and/or the Palmer Overlay District . Criteria met. <br />
