1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A <br />MINOR SUBDIVISION, SPECIAL USE PERMIT, AND SITE PLAN FOR CONSTRUCTION OF <br />SILVER LAKE SMILES AT 2350 PALMER DRIVE <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, NROCK Properties LLC & RLNB Properties LLC (the “Applicants”) have made application to <br />the City for a minor subdivision, special use permit, and site plan review for the property at 2350 Palmer <br />Drive which is legally described as: <br /> <br />Lot 11, Block 1, Robin Woods and Tract B, Registered Land Survey No. 237, Ramsey <br />County, Minnesota. Subject to easements of record. <br /> <br />WHEREAS, the minor subdivision would result in a new lot of 0.44 acres, and leave the existing lot with <br />1.28 acres; and <br /> <br />WHEREAS, the requested Special Use Permit would allow construction of a building within the typical front <br />yard setback from Palmer Drive in accordance with the Palmer Overlay District; and <br /> <br />WHEREAS, the requested site plan review would authorize construction of a 3168 square foot building with <br />site improvements as required by code; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission on August 21, 2018; and <br />WHEREAS, the Planning Commission held a public hearing on the request at the August 21st meeting and <br />considered input from residents; and <br />WHEREAS, the Planning Commission recommended approval of the request based on the applicant’s <br />submittals and findings of fact; and <br />WHEREAS, the City Council considered on August 28, 2018, the recommendations of the Planning <br />Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence available <br />to the Council.
