2 <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton hereby <br />approves the requested minor subdivision, special use permit, and site plan review based on the following <br />findings of fact: <br />1. The subject site is guided for community business by the comprehensive plan, and <br />professional service occupations (including dentist offices) are an allowed use within the <br />B-3 zoning district. <br />2. The proposed subdivision will not result in any nonconformities for the existing use (The <br />Garage). <br />3. The existing and proposed buildings will be conforming to floor area ratio standards <br />applicable to each lot. <br />4. A geotechnical analysis of the site provided by the applicant shows the land is suitable for <br />the proposed construction. <br />5. Proposed improvements to landscaping and lighting will be conforming to the underlying <br />zoning (B-3) and/or Palmer Overlay District standards. <br />6. The site can be serviced by public utilities provided all engineering conditions are <br />addressed. <br />7. Parking on both resulting sites will be conforming to code requirements. <br />8. The proposed location of the new building will not endanger the public health or general <br />welfare. <br />9. The new building will not impair area property values. <br />10. The new building will not impact development on surrounding properties. <br /> <br />BE IT FURTHER RESOLVED, that approval of the minor subdivision, special use permit, and site plan <br />review shall be subject to the following conditions: <br />1. Construction shall be consistent with all plans approved as part of this special use permit <br />and site plan review except as required to be updated by City Staff to conform to conditions <br />of approval. <br />2. All changes requested by the City Engineer in the review memo dated 8/7/18 shall be <br />implemented on the final plans prior to permits being issued. <br />3. All changes requested by Public Safety in the review memo dated 8/9/18 shall be <br />implemented on the final plans prior to permits being issued. <br />4. Easements for drainage and utility purposes shall be dedicated as needed per the direction <br />of the City Engineer. <br />5. Prior to recording the subdivision, the applicant shall provide sufficient <br />evidence/documentation to the City Attorney regarding the following: <br />a. That no further parties (beyond the applicants) have an interest in the land; and <br />b. Easement agreements with adjacent properties (regarding ingress/egress, shared <br />parking, etc) are properly prepared and executed.
