1 <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A <br />SPECIAL USE PERMIT TO AUTHORIZE AN ACCESSORY STRUCTURE (GARAGE) IN <br />EXCESS OF 624 SQUARE FEET FOR THE PROPERTY AT 875 3RD AVENUE NW <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Joel and Karen Werronen (the “Applicants”) made application to the City on 7/31/18 for a <br />special use permit to authorize construction of an accessory structure (garage) in excess of 624 square feet for <br />the property at 875 3rd Avenue NW which is legally describe as: <br />Lot 38 and 39, Block 2, Second Addition to New Brighton, Ramsey County, Minnesota. <br />and <br /> <br />WHEREAS, the existing garage being replaced is currently legal nonconforming to required setbacks and the <br />new garage will be conforming to codes in every way; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission on September 18, 2018; and <br />WHEREAS, the Planning Commission held a public hearing on the request at the September 18th meeting <br />and considered input from residents; and <br />WHEREAS, the Planning Commission recommended approval of the request based on the applicant’s <br />submittals and findings of fact; and <br />WHEREAS, the City Council considered on September 25, 2018, the recommendations of the Planning <br />Commission, staff, the Applicant's submissions, the contents of the staff report, and other evidence available <br />to the Council. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton hereby <br />approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for residential use by the comprehensive plan, and a <br />detached garage in excess of 624 square feet can be permitted via a special use permit in <br />the corresponding R-1A zoning district.
