Special Use Permit – 875 3rd Avenue NW <br />Planning Commission Report; 9-18-18 <br /> <br /> <br />Page 7 <br />Template Approval <br />Motion: <br />RECOMMENDED <br /> “I move we recommend the City Council approve the requested special use <br />permit based on the findings of fact and recommended conditions listed on <br />page 7 of the staff report.” <br /> <br />Suggested Findings <br />of Fact: <br /> <br />1. The subject property is guided for residential use by the comprehensive plan, <br />and a detached garage in excess of 624 square feet can be permitted via a <br />special use permit in the corresponding R-1A zoning district. <br />2. Construction of the proposed garage will not be detrimental to or endanger the <br />public health, safety, morals, comfort, or general welfare. <br />3. The new conforming garage will replace an existing legal nonconforming <br />garage, and will not be detrimental to uses on the subject property or on <br />surrounding lands. <br />4. Construction of the proposed garage will not have a detrimental impact on <br />area property values. <br />5. The subject site is adequately served by public utilities, roads, and drainage <br />facilities to accommodate the proposed use. <br />6. The special use will be in conformance with all underlying zoning district <br />requirements. <br /> <br />Recommended <br />Conditions: <br />1. The Special Use Permit shall authorize the location and size of garage as <br />shown on the Certificate of Survey for 875 3rd Avenue NW dated 7/31/18; any <br />changes to the location or size of the garage shall require an amendment to <br />this permit. <br />2. Roof and exterior color and material(s) must be consistent and complimentary <br />with the principal structure. <br />3. No commercial or home occupation activity shall be conducted within the <br />detached garage. <br />4. Final building plans must show the resulting drainage will not adversely <br />impact neighboring properties. <br />5.
