Special Use Permit – Silver Lake Auto <br />Planning Commission Report; 9-18-18 <br /> <br /> <br />Page 4 <br />Special Use Permit Review <br />In General: The need for a Special Use Permit is triggered by the specific use of “automobile <br />sales” in the I-1 District. Zoning allows the City to approve any use within the I-1 <br />district by special use permit except those uses specifically guided for the City’s I- <br />2 district <br /> <br />Criteria Review: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Zoning Code Section 8-130 contains five standards the City must review prior to making <br />a decision on any specially permitted use. The applicant and staff analysis of these <br />standards is shown below: <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />APPLICANT COMMENTS: Silver Lake Auto’s operations are strictly a <br />professional setting. Since we are a logistical office, we will comply and never <br />endanger any general welfare. <br />STAFF COMMENTS: Staff finds this criterion to be met. The property is designed <br />for office uses like Silver Lake Auto, and no part of the proposed business should <br />be detrimental to the public health, safety, morals, comfort or general welfare of the <br />community. Other than a new sign on the building, staff suspects the business will <br />largely go unnoticed. <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />APPLICANT COMMENTS: Silver Lake Auto will maintain a clean and <br />professional office. We will be running a quiet operation. Other offices won’t even <br />notice us as renters on the property. <br />STAFF COMMENTS: Staff finds this criterion to be met. The proposed use is <br />consistent with other uses on site and no aspect of the use suggests it will impair <br />area property values. <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />APPLICANT COMMENTS: Silver Lake Auto is a logistical office. We will not <br />impede any situation concerning the district. <br />STAFF COMMENTS: Staff finds this criterion to be met. Silver Lake Auto will <br />have no impact on the use or leasing of other suites in the building, and will not <br />impact the uses on adjacent property. <br />
