Special Use Permit – Silver Lake Auto <br />Planning Commission Report; 9-18-18 <br /> <br /> <br />Page 6 <br />Commission <br />Options: <br />The Planning Commission has the following options: <br />A) RECOMMEND APPROVAL OF THE REQUEST based on the <br />applicant’s submittals and findings of fact. <br />B) RECOMMEND DENIAL OF THE REQUEST based on the applicant’s <br />submittals and findings of fact. <br />C) TABLE THE ITEM and request additional information. <br />Based on an application date of 8/24/18, the 60-day review period for this <br />application expires on 10/23/2018. This deadline can be extended an additional <br />60 days if more time is necessary. <br /> <br />Template Denial <br />Motion: <br />(not recommended) <br /> “I move that we recommend the City Council deny the requested special use <br />permit based on the following findings of fact:” <br />o (provide findings to support your conclusion) <br /> <br />Template Approval <br />Motion: <br />RECOMMENDED <br /> “I move we recommend the City Council approve the requested special use <br />permit based on the findings of fact listed on page 6 of the report subject to <br />the conditions listed on page 7 as may have been amended here tonight.” <br /> <br />Suggested Findings <br />of Fact: <br /> <br />1. The subject property is guided for light industrial by the comprehensive plan, <br />and automotive sales can be permitted via a special use permit in the <br />corresponding I-1 zoning district. <br />2. Establishment, maintenance, and operation of an automotive sales business at <br />the proposed location will not be detrimental to or endanger the public health, <br />safety, morals, comfort, or general welfare. <br />3. The existing building and associated parking can accommodate the use <br />without impacting other on-site businesses or surrounding lands. <br />4. Filling vacant space within an existing office building will not have <br />detrimental impact on area property values. <br />5. The subject site is adequately served by public utilities, roads, and drainage <br />facilities to accommodate the proposed use. <br />6. The special use will be in conformance with all underlying zoning district <br />requirements.
