2 <br />WHEREAS, the City Council considered on September 25, 2018, the recommendations of the Planning <br />Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence available <br />to the Council. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton hereby <br />approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for light industrial by the comprehensive plan, and <br />automotive sales can be permitted via a special use permit in the corresponding I-1 zoning <br />district. <br />2. Establishment, maintenance, and operation of an automotive sales business at the proposed <br />location will not be detrimental to or endanger the public health, safety, morals, comfort, <br />or general welfare. <br />3. The existing building and associated parking can accommodate the use without impacting <br />other on-site businesses or surrounding lands. <br />4. Filling vacant space within an existing office building will not have detrimental impact on <br />area property values. <br />5. The subject site is adequately served by public utilities, roads, and drainage facilities to <br />accommodate the proposed use. <br />6. The special use will be in conformance with all underlying zoning district requirements. <br />BE IT FURTHER RESOLVED, that approval of the special use permit shall be subject to the following <br />conditions: <br />1. The Special Use Permit shall authorize the use in Suite 1 as depicted on the application <br />materials, and the use of seven (7) shared parking spaces within the office building parking <br />lot. <br />2. No more than five (5) parking spaces shall be used for the on-site storage of vehicles being <br />sold as part of the automotive sales business. <br />3. Any vehicles located on the property, whether advertised for sale or not, shall be operable, <br />in good repair, and be properly licensed. <br />4. Inoperable and/or unlicensed vehicles may not be kept on site. <br />5. No balloons, streamers, blow-ups, or similar advertising devices shall be displayed on site. <br />6. Only a single wall sign in compliance with Chapter 9 of the Zoning Code may be permitted <br />after obtaining a Permanent Sign Permit. <br />7. Failure to adhere to these conditions of approval shall be grounds for revocation of the <br />special use permit by the City Council. <br /> <br /> <br /> <br /> <br />
