<br /> <br />3 <br /> <br />Motion by Commissioner Frush, seconded by Commissioner Murphy to recommend the City Council <br />approve the request based on the applicant’s submittals, the findings of fact and the recommended <br />conditions. <br />Approved 5-0. <br /> <br />(B) SPECIAL USE PERMIT: A request from Bilal Haidari, owner of Silver Lake Auto, to operate an <br />online auto sales business (with no car lot) from an existing office located at 550 County Road D <br />West, Suite 1 – PID: 32-30-23-43-0013. <br />City Planner Gozola reported Mr. Bilal Haidari is seeking approval of a special use permit to allow for <br />operation of an automobile sales business from an existing office space at 550 County Road D West, <br />Suite 1. Silver Lake Auto Sales has outgrown their current office space in St. Anthony, and is seeking a <br />new office location in New Brighton from which to run their business. The business is entirely an on- <br />line operation with most car transactions occurring overseas. According to the applicant, no inventory <br />will ever be stored on site; however, to qualify for a dealer’s license at this location, a minimum of five <br />(5) spaces must be reserved for potential on-site storage (hence the special use permit for “automobile <br />sales” as opposed to an office use which would be outright allowed. Staff recommended approval of <br />the Special Use Permit with the following conditions: <br />1. The Special Use Permit shall authorize the use in Suite 1 as depicted on the application materials, <br />and the use of seven (7) shared parking spaces within the office building parking lot. <br />2. No more than five (5) parking spaces shall be used for the on-site storage of vehicles being sold as <br />part of the automotive sales business. <br />3. Any vehicles located on the property, whether advertised for sale or not, shall be operable, in <br />good repair, and be properly licensed. <br />4. Inoperable and/or unlicensed vehicles may not be kept on site. <br />5. No balloons, streamers, blow-ups, or similar advertising devices shall be displayed on site. <br />6. Only a single wall sign in compliance with Chapter 9 of the Zoning Code may be permitted after <br />obtaining a Permanent Sign Permit. <br />7. Failure to adhere to these conditions of approval shall be grounds for revocation of the special <br />use permit by the City Council. <br />Commissioner Frush asked if the use would have five or seven parking stalls. City Planner Gozola <br />reported five spaces were required for the use, but noted the applicant had been assigned seven <br />spaces for the business by the building owner. <br />Commissioner Frush requested further information regarding cascading uses. City Planner Gozola <br />described for the Commission how cascading uses currently work within the current zoning ordinance, <br />and why it is in the City’s best interest to eliminate such at some point in the future.
