Special Use Permit – Bel Air Elementary
Planning Commission Report; 12-18-18

Page 10

Template Denial
Motion:
(not recommended)
“I move that we recommend the City Council deny the requested special use
permit based on the following findings of fact:”
o (provide findings to support your conclusion)

Template Approval
Motion:
RECOMMENDED
“I move we recommend the City Council approve the requested special use
based on the findings of fact listed on page 10 of the report subject to the
conditions listed on pages 10 & 11 as may have been amended here tonight.”

Suggested Findings
of Fact:
1. The subject property is guided for public/quasi-public use by the
comprehensive plan, and schools are a specially permitted use in the
corresponding R-1 zoning district.
2. Continued operation of a school at the proposed location will not be
detrimental to or endanger the public health, safety, morals, comfort, or
general welfare of the community.
3. The proposed school improvements will not impact the use and enjoyment of
the subject and surrounding properties provided conditions regarding bus
routing are adhered to.
4. The small additions to the school building will not have detrimental impact on
area property values.
5. The proposed changes to Bel Air Elementary will have no impact on the
subsequent development (or redevelopment) of surrounding property.
6. The subject site appears to be adequately served by public utilities, roads, and
drainage facilities to accommodate the proposed use; existing services will be
examined and repaired by the School District if needed.
7. The special use will be in conformance with all underlying zoning district
requirements.

Recommended
Conditions:

1. pieces of right-of-way for 19th and 20th Streets, and shall dedicate public
easements in such areas as deemed necessary during that process.
2. Landscaping plans shall be reviewed by the City Forester, and any suggested
changes to the planting mix shall be implemented with the future project.
3. Engineering comments in the 12/12/18 Engineering Memo shall all be
successfully addressed prior to issuance of a building permit.
