<br />. <br />. <br /> <br />Ii <br />Ii <br />II <br />Ii <br /> <br />.-/ <br /> <br />., <br />i <br />!I <br />1 <br /> <br />'RESOLUTIONNO.95-096 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A SPECIAL USE PERMIT <br />SP-188. <br /> <br />WHEREAS, an application for a special use permit, SP-188, has been made by Belair Builders, <br />Inc. to extract sand from a three acre industrial site. <br /> <br />II 1. <br />'l <br />:; <br />11 2. <br />.' <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />An application for a special use permit, SP-188, was filed with the City of New Brighton <br />on September 29, 1995. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on October 17, 1995, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered Sp.188 at its October 24, 1995, meeting. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />;; respect to SP-188: <br /> <br />:! 1. The subject site is zoned 1-1, Light Industrial. <br />2. The applicant proposes to excavate 88,000 cubic yards of sand material from a three acre <br />site owned by Ramsey County and a 1.5 acre site owned by the U.S. Army from <br />November 15,1995, to December 31, 2000. <br />The excavation of sand material of over 100 cubic yards in an 1-1 district requires a <br />special use permit <br />The proposed excavation site would be located northwest of Rush Lake, north of Long <br />Lake Regional Park, and south and west ofthe U.S. Army railroad tracks. <br />The applicant would replace the sand material with clean soils brought in from outside <br />construction sites. <br />The applicant would install security fencing around the excavation site. <br />The applicant would take all necessary erosion control measures to avoid runoff into <br />Rush Lake. <br />The proposed excavation site would not be visible from the residential area to the west, <br />Old Highway 8 or the developed industrial sites to the east, or from the developed portion <br />of Long Lake Regional Park to the south. <br />9. The excavation project wou:ld generate an average of four to six truck trips per day, which <br />would travel north across the applicant's site and then east to Old Highway 8. <br />10. The applicant's site currently generates truck traffic hauling sand, construction site soils, <br />concrete and bituminous material. According to the applicant, the increase in truck traffic <br />from the excavation site would not be noticeable. <br />11. The applicant is working with the U.S. Army, the Minnesota Pollution Control Agency, <br />the Rice Creek Watershed District, Ramsey County, and the Audubon Society to secure <br />access across the Army railroad right-of-way, to protect against erosion and runoff, and to <br />ensure the 4.5 acre site is restored to its natural grade and condition. <br />12.
