That the special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. 14. That the establishment of the special use will not impede the normal and orderly development and improvement ofthe surrounding property for uses permitted in the district. 15. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being provided. 16. That the special use shall in all other respects conform to the applicable regulations ofthe district in which it is located. BE IT FURTHER RESOLVED, the application SP-188 is hereby approved subject to the following conditions: 1. Conformance and adherence to all standards for special use as pertains in Section 8-110 and 8-130 of the New Brighton Zoning Ordinance. 2. Provision of a Restoration Bond in an amount to be determined by the City Building Official prior to the issuance of an Excavation Permit. 3. Obtain all necessary approvals from the U.S. Army, The Minnesota Pollution Control Agency, Rice Creek Watershed District, and Ramsey County, prior to the issuance of an Excavation Permit. 4. City Engineer approval of grading and drainage plans. 5. All excavation and site restoration activity be completed by December 31, 2000, or at the completion of all excavation and fill activity, whichever is earlier. 6. All truck traffic generated by the excavation project travel no further south than Highway 96 on Old Highway 8. 7. The applicant agrees to water and sweep the access road from Old Highway 8 to the excavation site once a day or as needed to control dust. 8. Install security fencing around excavation site. 9. Install fencing around the southwest hill area as identified by the Department of Natural Resources and Audubon So~iety. 10. The Restoration Bond not be released by the City until representatives of the U.S. Army, Rice Creek Watershed District, Minnesota Pollution Control Agency, and Ramsey County, have inspected the site and find it to be restored and in compliance with approved plans and requirements. 11.
