That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />14. That the establishment of the special use will not impede the normal and orderly <br />development and improvement ofthe surrounding property for uses permitted in the <br />district. <br />15. That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />16. That the special use shall in all other respects conform to the applicable regulations ofthe <br />district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-188 is hereby approved subject to the following <br />conditions: <br /> <br />1. Conformance and adherence to all standards for special use as pertains in Section 8-110 <br />and 8-130 of the New Brighton Zoning Ordinance. <br />2. Provision of a Restoration Bond in an amount to be determined by the City Building <br />Official prior to the issuance of an Excavation Permit. <br />3. Obtain all necessary approvals from the U.S. Army, The Minnesota Pollution Control <br />Agency, Rice Creek Watershed District, and Ramsey County, prior to the issuance of an <br />Excavation Permit. <br />4. City Engineer approval of grading and drainage plans. <br />5. All excavation and site restoration activity be completed by December 31, 2000, or at the <br />completion of all excavation and fill activity, whichever is earlier. <br />6. All truck traffic generated by the excavation project travel no further south than Highway <br />96 on Old Highway 8. <br />7. The applicant agrees to water and sweep the access road from Old Highway 8 to the <br />excavation site once a day or as needed to control dust. <br />8. Install security fencing around excavation site. <br />9. Install fencing around the southwest hill area as identified by the Department of Natural <br />Resources and Audubon So~iety. <br />10. The Restoration Bond not be released by the City until representatives of the U.S. Army, <br />Rice Creek Watershed District, Minnesota Pollution Control Agency, and Ramsey <br />County, have inspected the site and find it to be restored and in compliance with <br />approved plans and requirements. <br />11.
