Public Hearing <br />1) Special Use Permit: Request to remove a legal nonconforming garage within a side yard <br />setback, and replace it with an oversized 960 square foot garage conforming to setbacks at 821 <br />7th Avenue NW – PID 29-30-23-12-0025. <br />Assistant Director of Community Assets and Development Gozola reported Ron and Jackie Finney are <br />seeking the City’s approval to remove an existing legal nonconforming 420 sq. ft. 1-car garage from <br />the property and replace it with a new 960 sq. ft three-car garage. Detached accessory structures in <br />residential districts in excess of 624 square feet are an allowed use but only if approved via special <br />use permit. Staff has reviewed the proposed improvement in relation to the standard SUP criteria <br />and the three additional criteria for this type of request, and we find all potential issues are <br />addressable via conditions. Staff provided further comment on the request and recommended <br />approval of the Special Use Permit, based on the suggested findings of fact and subject to the <br />following conditions: <br />1. The Special Use Permit shall authorize the location and size of garage as shown on the <br />Certificate of Survey for 821 7th Ave NW dated 04/02/2019; any changes to the location or <br />size of the garage shall require an amendment to this permit. <br />2. Roof and exterior color and material(s) must be consistent and complimentary with the <br />principal structure. <br />3. No commercial or home occupation activity shall be conducted within the detached garage. <br />4. Final building plans must show the resulting drainage will not adversely impact neighboring <br />properties. <br />5. Failure to adhere to conditions of approval shall be grounds for revocation of the special use <br />permit by the City Council. <br />Ron Finney, 821 7th Avenue NW, explained he was requesting to replace his single car garage with a <br />three-car garage. <br />Chair Nichols-Matkaiti opened the Public Hearing at 7:06 p.m. <br />There were no comments from the public. <br /> <br />Motion by Commissioner Biedenfeld, seconded by Commissioner Frush, to close the Public <br />Hearing. <br />Approved 7-0. <br />Chair Nichols-Matkaiti closed the Public Hearing at 7:07 p.m. <br /> <br />Motion by Commissioner McQuillan, seconded by Commissioner Frischman, to approve staff <br />recommendation. <br />Approved 7-0. <br /> <br />
