<br /> <br />5 <br /> <br />Mr. Kowalik commented he would rather not have the asterisk in place. Assistant Director of <br />Community Assets and Development Gozola explained it would be to the property owners <br />benefit to have this asterisk or option for the property in place. He indicated the property would <br />not be marked in any way that would raise any red flags, but rather would simply have a notation <br />on the Comprehensive Plan that the site could be rezoned to multi-family per the property <br />owners request. He commented further on how it would benefit the City to not force the <br />property owner but denote the City was willing to work with the property owner. <br />Motion by Commissioner McQuillan, seconded by Commissioner Melquist, to recommend the <br />City Council approve Ordinance 872, including the asterisk for the property at 1001 and 1021 <br />County Road E. <br />Approved 6-0. <br />VII. Business Items <br />1) PRELIMINARY AND FINAL PLAT: An application from Murlowski Properties, Inc. to replat the <br />four properties at 2200 Old Highway 9 into two parcels, and to clean up legal descriptions <br />between this property and adjacent lands. No new lots will be created as a result of this <br />platting process. PIDs: 17-30-41-0013, 17-30-23-42-0004, 17-30-23-43-0005, and 17-30-23-42- <br />0006. <br />Assistant Director of Community Assets and Development Gozola reported Murlowski Properties <br />Inc. are seeking to clean up the legal descriptions between their properties and su rrounding <br />properties to position the property for future development or sale. Through this plat, the <br />existing four parcels will be combined into two. Boundaries for the resulting parcels will mimic <br />existing parcel lines. The only visible changes will largely be to the legal descriptions of the land <br />in this area. Staff provided further comment on the request and recommended approval of the <br />Preliminary and Final Plat, based on the findings of fact and subject to the following conditions: <br />1. The applicant shall work with the City Attorney to finalize an acceptable roadway access <br />easement across the entire northern boundary of Lot 1, Block 1; easement to be dedicated as <br />part of the plat or as a separate instrument per Attorney direction. <br />2. An easement shall be dedicated over the storm water pipe extending northward from Rush <br />Lake as directed by the City Engineer. <br />Mr. Biedenfeld asked if the property owner had any comments or questions. <br />Anthony Murlowski, applicant, indicated he would be building a road on Lot 2 on the south end <br />of the property along the railroad tracks for secondary access to the site. Assistant Director of <br />Community Assets and Development Gozola reported staff would work with the applicant on this <br />matter. He explained these decisions would be made when Lot 2 develops at some point in the <br />future. <br />
