Consider Resolution to Vacate portions of a cul-de-sac on 7th Avenue NW, and
Vacation of a portion of 7th Street NW adjacent to the Midtown Village
Development.

Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt a Resolution
approving the partial right-of-way vacations to portions of a cul-de-sac on 7th Avenue NW, and
Vacation of a portion of 7th Street NW adjacent to the Midtown Village Development as
part of the recent Midtown Village Phase I (Pulte) approval.

City Manager Lotter indicated Assistant Director of Community Assets and Development Gozola would be
presenting this item to the Council.
Assistant Director of Community Assets and Development Gozola stated as part of the Preliminary PRD
review for the Midtown Village development, it was determined that the City should move forward with a
vacation of unused cul-de-sac right-of-way on 7th Avenue NW, and the vacation of 7th Street NW between
7th & 8th Avenues. With Pulte now moving forward with Phase I of the development, the planned vacations
must go through a formal approval process. By code, the City Council (and not the Planning Commission) is
to hold the public hearing on vacations, and make a determination as to whether there is any public interest in
maintaining the right-of-way. Both staff and the planning commission, as part of the preliminary approval
process, recommended approval of the vacations for the following reasons:

 The unused cul-de-sac bulb on 7th Avenue NW has not been utilized since its platting in the 1930’s,
and construction on adjacent lots over the years have resulted in multiple encroachments that need to
be addressed.
 The ROW for 7th St between 7th & 8th Avenues serves a very limited public purpose, and
reconfiguration of roadways in the area as part of Midtown Village (Phase I) works better for both
the developer and adjacent residents. The two single family homes to the north of Midtown Village
between 7th & 8th Avenues will each get a new driveway installed courtesy of the developer, and
each lot will increase in size to encompass the new drive. Greenspace will replace the remaining
roadway area providing an improved aesthetic buffer between old and new.

10. Auth.
