the demanded ROW cannot be accommodated without impacting both
grading plans and building locations, so they would be forced back into the
preliminary PRD stage of review. This will cost Dominium thousands in plan
updates, will result in a months-long delay of their portion of the project, and
will require both Council and staff to hold additional meetings and public
hearings on what has already been a very contentious issue for some
residents. Despite these downsides, Dominium is willing to reopen the
preliminary approval to accommodate the County’s wishes. While they likely
have a great legal position in this matter, it is more important to them to
keep and maintain a strong relationship with the County than it is to fight this
unusual occurance.

The attached draft letter, if approved by Council, would be sent to the Board
of County Commissioners to recognize what has happened, ask that they
recind the request, and also request that steps be taken to ensure there is a
more appropriate response in the future should similar circumst ances ever
occur again.

Attachments: 1) Proposed letter from the City Council to the Ramsey County Board of
Commissioners

________________________
Ben Gozola, AICP
Assistant Director of Community Assets and Development
