REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Consideration of Letter to Ramsey County to support current ROW on Old <br />Highway 8 <br />DEPARTMENT HEAD’S APPROVAL: <br />CITY MANAGER’S APPROVAL: <br />No comments to supplement this report ___ Comments attached ___ <br />15.99 Deadline: none <br />Recommendations: Approval of a letter to send to the County regarding Midtown Village and <br />Old Highway 8 right-of-way <br />Legislative History: Midtown Village Preliminary Approval on 5/28/19 <br />Pulte Final Plat Approval on 8/12/19 <br />9/4/19: County acknowledges “errors” on there end during the <br />development review, and indicates they would like an additional 10 feet of <br />ROW dedication to the north and south of Old Highway 8 in the Midtown <br />Village development. <br />Financial Impact: No impact to the City; additional cost and time delays for Dominium <br />Summary: As part of any platting process, jurisdictions have the opportunity to request <br />additional ROW for their corridors. Ramsey County (like all other partnering <br />agencies) was given over one month to review the Midtown Village <br />development plans, and did not identify the need for additional ROW so none <br />was requested from either developer. Upon seeking review of the final plat <br />for Pulte by the County surveyor, it came to light that the County planning <br />documents require a full 100’ of ROW along this stretch of Old Highway 8 <br />rather than the 80’ that currently exists. Based on those documents and <br />regardless of the approvals already granted by the City, Ramsey County staff <br />is now directing the developers to provide the additional ROW. <br />In the case of Pulte, an additional 10-foot highway easement can be added to <br />the plat without impacting building locations or grading plans. So while they <br />do not care for the County’s actions and how this came about so late in the <br />process, Pulte will be complying with the demand and will not be required to <br />re-open their applications for plan amendments.
