Specific Code Issues to Address (continued) <br />Goal <br />26. Correct all structural code problems <br />• "Interim uses" are a use type like permitted uses <br />and conditionally permitted uses, but the present <br />code sets up interim regulations as a zoning district <br />which makes no sense and is therefore unusable. <br />• The current code establishes general performance <br />standards for all industrial uses, but places the <br />general standards as a subset of 1-3 regulations. <br />This placement in the current code exposes the City <br />to a legal argument that general regulations are <br />only apply to 1-3 uses. <br />27. Update or eliminate unused zoning districts (i.e. the <br />R-4 District, the R-3131 District, and the MX -G District all <br />exist in the zoning code, but none are presently used on <br />the City's zoning map). The R-4 district should <br />specifically be updated to ensure we have a proper <br />zoning district to govern the City's various mobile home <br />parks. <br />28. Clearly document overlay districts in code and on <br />the zoning map. Presently, there are arguably three <br />overlay districts in the present code: the Palmer Drive <br />Overlay area (which is not identified on the zoning map), <br />the Shoreland District (which is not identified as an <br />overlay district and is also not shown on the zoning <br />map), and the Environmental Constraint Overlay Area <br />(also not shown on the zoning map). The City has also <br />adopted multiple PRDs and PUDs which arguably are <br />also overlay districts over-riding underlying zoning in <br />certain ways. All such matters should be cleaned up in <br />as much as possible. <br />A N N O T A T E D O U T L I N E <br />N E W B R I G H T O N Z O N I N G U P D A T E <br />ZONING UPDATE GOALS <br />■ The new ordinance will ensure regulations are <br />properly placed, can be easily found, and follow all <br />legal standards for establishment and use. <br />■ The new ordinance will only recognize and include <br />zoning districts which are actually being used by <br />the City. All defunct districts will be eliminated, and <br />only needed new districts will be added. <br />■ The new ordinance will clearly identify all overlay <br />districts in a coordinated location within the new <br />code. Overlay regulations will supersede underlying <br />zoning, and anything not specifically addressed by <br />an overlay district will be subject to the underlying <br />zoning district regulation. This ensures there are no <br />gaps in overlay zoning regulations. <br />I <br />
