ZONING UPDATE GOALS <br />Specific Code Issues to Address (continued) <br />Goal <br />19. Illustrations — existing ones need to be updated for <br />clarity, and more should be included to increase user <br />understanding of various regulations. <br />20. Eliminate code inconsistencies (i.e. the definition of a <br />parking space states that all spaces shall be 20' long <br />while the City's parking standards indicate the minimum <br />space length is 18'). <br />21. Extraction of materials (i.e. mining) should not be a <br />special/conditionally permitted use, and instead should <br />be interim permitted (only allowed if certain conditions <br />exist, requires a sunset date, requires a restoration plan, <br />etc). <br />22. Eliminate procedures not allowed by statute (i.e. <br />Council granting "special permission" to change setback <br />requirements outside of a variance procedure). <br />23. Eliminate cascading zoning districts (i.e. permitted <br />uses in the R-36 district reference uses in the R-2 <br />district, and the R-2 district references the R-1 district. <br />Accordingly, readers must consult all three districts to <br />understand what is permitted in the R-313 district). <br />24. Fill gaps in existing regulations (i.e. in the R -1A <br />district, the City has a maximum hardcover of 55% for <br />lots less than 7,500 square feet, but NO maximum for <br />lots larger than 7,500 feet). <br />25. Formatting: make sure tables spanning two or more <br />pages include header information on each page, make <br />sure column information is property lined up and spaced, <br />etc. <br />Technique() Used to Address the Goal <br />■ Illustrations will be added to the new code as <br />needed to provide clarity, and/or as directed by the <br />Planning Commission, Council, or project steering <br />committee. <br />■ Importantly, the new code will strive at all times to <br />list a zoning requirement only ONCE in its proper <br />location. Should other sections call for a duplicate <br />requirement, the singular notation will be <br />referenced. This approach guards against future <br />mistakes because as code is updated, changes <br />being made will be universally applicable. <br />■ Mining operations should ALWAYS be an interim <br />permitted use. They are the reason IUP provisions <br />were added to statute. <br />■ The new code will be reviewed by the City's legal <br />counsel to ensure the new provisions are in-line <br />with current statutory language. <br />■ The new zoning ordinance will employ tables to <br />communicate where different uses are allowed, and <br />what process must be completed prior to the use <br />being established (i.e. permitted, CUP, IUP). <br />■ Each zoning district in the new code will follow a <br />similar format to ensure all such gaps are <br />eliminated. <br />• The new ordinance will be formatted for ease of <br />reading.
