Assistant Director <br />of Community Assets and Development Gozola explained the right-of-way would not be vacated. <br />Commissioner Biedenfeld thanked the applicant for putting in the effort come up with a creative <br />solution for his property. <br />Chair Nichols-Matkaiti agreed and thanked staff and the applicant for finding a solution. <br />Chair Nichols-Matkaiti opened the Public Hearing at 7:20 p.m. <br />Mike Murlowski, 2200 Old Highway 8, thanked staff for their time and effort. He appreciated the <br />solution that has been created because it takes care of his interests as well as the City’s interests. <br />Motion by Commissioner McQuillan, seconded by Commissioner Biedenfeld to close the Public <br />Hearing. <br />A roll call vote was taken. Approved 6-0. <br />2) Benedictine Health Center rezoning and PRD Amendment: <br />a. Ordinance 873: Adopting of an Ordinance rezoning property located at 2722 I-694 Service <br />Drive from B-1 to R-3B (PID 19-30-23-34-0010). The proposed rezoning would allow for <br />consideration of a revised Planned Residential Development for the Benedictine Health <br />Center in compliance with the new Comprehensive Plan. <br />Assistant Director of Community Assets and Development Gozola reported State law provides <br />cities with nine months to update zoning ordinances and maps following approval of a new <br />comprehensive plan. The recently approved 2040 Comp Plan initiated that time clock, and the <br />City undertook an effort to update zoning classifications throughout the City in compliance <br />with the new plan. Some areas, like the subject parcel, were deemed to have compliant <br />zoning as the City has yet to establish new zoning for its mixed use areas, and applicants could <br />request a rezoning should they come forward with a PRD application to fulfill the Comp Plan <br />goals. In 2019, the Benedictine Health Center requested and received approval of rezoning for <br />two parcels adjacent to their campus, and subsequently gained approval of a PRD to expand <br />their facility. Following those approvals, the Benedictine’s were presented with an <br />opportunity to acquire the parcel subject to this application, and they’ve elected to re- <br />examine their PRD to incorporate this additional land. As a preliminary step; however, they <br />must once again request rezoning of property to accommodate their use. Like the 2019 <br />requests, this application is consistent with the 2040 Comprehensive Plan, and is therefore
