<br /> <br />6 <br /> <br />2) Variance: Request from Lauris Valtinson for a height variance to accommodate a replacement <br />sign above the new MnDOT sound wall on I-35W for the business at 388 Cleveland Avenue SW <br />– PID 32-30-23-14-0016. <br />Assistant Director of Community Assets and Development Gozola reported Lauris Valtinson acquired <br />the property at 386 Cleveland Avenue in 2015 which included a legal nonconforming freeway sign <br />facing I-35W. With the new sound wall now going up, Mr. Valtinson is seeking a way to keep the legal <br />nonconforming sign visible once the wall is up. Staff provided further comment on the request and <br />recommended approval of the revised Variance, based on the findings of fact and subject to the <br />following conditions: <br />1. The proposed sign shall meet the required 10-foot setback from the rear property line. <br />2. The proposed dynamic electronic display shall not be used as a Billboard (advertising things <br />other than the business on the premises) which is a prohibited sign type in the B-1 district. <br />3. The dynamic electronic display shall meet all requirements of code specific to that sign type. <br />4. The final sign height shall not exceed 29’ from the ground to the top of the sign. <br />5. Failure to adhere to all conditions of approval shall be grounds to revoke the variance and <br />require removal of the sign. All costs for sign removal and site restoration shall be the <br />responsibility of the landowner in such an event. <br />6. The applicant shall obtain a sign permit and all other necessary and approvals from the City <br />and other applicable entities with jurisdiction prior to any construction. <br />7. The variance shall expire if a sign permit is not applied for within one year from the date of <br />resolution. <br />8. Light shields shall be installed on both sides of the sign. <br />Commissioner Biedenfeld stated he was pleased the applicant was able to find a middle ground with <br />the City for this sign. <br />Commissioner Frischman questioned what the addresses were for the comments received regarding <br />the sign request. Assistant Director of Community Assets and Development Gozola reviewed the <br />location of the homeowners that provided comments to staff. <br />Chair Nichols-Matkaiti asked if staff could provide a visual on where the sign would be located on the <br />site. Assistant Director of Community Assets and Development Gozola discussed the location of the <br />proposed sign and noted where the new garage would be on the property. <br />Mr. Valtinson stated he had talked to all four of his neighbors regarding the sign and he wanted them <br />to be happy. He reported the sign would be located close to I-35W which meant it would not be that <br />visible from Cleveland Avenue. He explained he has worked at this location for years and <br />commented he would be handing his business down to his sons. He stated he has invested a great <br />deal into this site and he appreciated the fact his business would remain visible from I-35W.
