The impact of the expansion of any nonconformity upon adjacent premises is <br />reduced to the greatest practical extent. <br />STAFF COMMENTS: The nonconforming front yard setback will not be expanded <br />as a result of the proposed addition. The addition will be to the rear of the home in <br />a location that meets all required setbacks. <br />3. The extent of any nonconformity is reduced where practical. <br />STAFF COMMENTS: Given the facts of this case, staff finds there is no practical <br />way to reduce the existing nonconformity. It is not economically practical (or <br />reasonable) to require a resident to relocate their entire home prior to being allowed <br />to construct an addition that will conform to code in every way (regardless of <br />whether the home is moved or not). Criteria met. <br /> <br /> <br />Supplementary Review & Public Comment <br />Additional <br />Information: <br /> none <br /> <br />Engineering <br />Review: <br /> not applicable <br /> <br />Public Safety <br />Review: <br /> not applicable <br /> <br />Public <br />Comment: <br /> A neighbor, Brandon Stenglein who lives at 34 15th Ave SW, emailed the City in <br />full support of the application. <br /> A second neighbor, Nathan Anderson at 48 13th Ave SW, also emailed with <br />questions, and is in full support of the request after receiving clarification on what <br />was proposed. <br /> <br /> <br />Conclusion: <br /> The applicant is requesting a Nonconforming Use Permit to add a conforming <br />addition to the rear of an existing house that currently sits within the required front <br />yard setback. <br />Staff Recommendation: Per the analysis outlined in the report, staff is <br />recommending APPROVAL of the request. <br />
