I would say the most important things to know about this proposed project are: <br /> <br />1) The proposed addition will conform with city regulations in every way. I’ve worked for Cities <br />throughout the metro over the last 20 years, and had this project been proposed in any of those cities, <br />we would have just worked with the landowner and issued a building permit. <br /> <br />2) The City of New Brighton zoning code has some outdated/unique rules regarding legal <br />nonconformities that come into play on this particular property. Specifically, the front of the existing <br />home (which has nothing to do with the proposed addition off the back of the home) is currently <br />within the front yard setback. The owner of 23 15th Ave SW was obviously not responsible for the <br />original house location, but technically they must go through a special review process because any <br />addition to the home is considered an “expansion” of the legal nonconformity by our zoning code. <br /> <br />3) By law, we must notice all property owners within 350 feet of a property seeking this type of permit <br />so that you and your neighbors are aware of the public hearing and your opportunity to speak.
