All complaints on the BBB site that can be viewed had a direct response <br />from a Pulte representative, and only 2 were from developments in MN: one <br />about an association retaining wall dispute, and one was about build quality <br />which Pulte was actively addressing per their responses. <br />Again, based on the City’s past direct experience with this builder and the lack of <br />any concerning evidence suggesting a systemic problem with Pulte, staff has no <br />concerns about their commitment to excellence on this project or their ability to <br />perform. <br />INFRASTRUCTURE: <br />In General: All public improvements constructed to support the development must be designed <br />and constructed in accordance with the City's Private Development Standards. City <br />Engineer review of all proposed infrastructure is covered herein. <br /> <br />Streets and <br />Transportation: <br /> As a condition of approval, Engineering comments in the 5/16/19 Engineering Memo <br />(attached) shall be addressed. <br /> Main highlights: <br />o Pedestrian bump outs to be added to 8th Avenue intersections; <br />o Existing 7th St NW to be removed in favor of a new hammerhead turn around <br />at the end of 7th St NW; vacated ROW land distribution to be determined, and <br />new driveways for the two adjacent residents to be paid for by the developers; <br />o City to initiate vacation of old unused 1939 era cul-de-sac currently in the <br />middle of 7th Avenue; <br />o 8th Avenue extension needs to be adjusted to accommodate a future signal. <br /> Because Dominium runs non-smoking buildings with a policy that generally extends <br />to the entire grounds, staff has requested they either agree to amend the policy for <br />these buildings to allow for outdoor smoking on the shared building patios, or to <br />accommodate smokers in some other manner (so as to avoid smokers retreating to <br />public streets in order to smoke). Absent Dominium agreeing to such a request, the <br />City would require dedication of additional ROW at the end of the new 7th Street <br />extension that would extend into the landscaped patio entrance area to provide an “off <br />property” refuge at which residents could smoke. Legalities of such a solution would <br />need to be worked out with the City Attorney prior to Final Plan approval. Regardless <br />of the solution, Dominium would be expected to provide smoker-related waste <br />receptacles in the designated smoking area. <br />
