Preliminary Planned Residential Development <br />Planning Commission Report; 5-21-19 <br /> <br /> <br />Page 39 <br />CHARGES, FEES, & RESPONSIBILITIES: <br />Park <br />Dedication: <br /> <br /> <br /> <br /> <br /> <br /> Chapter 26, Article 4 of the City Code outlines requirements for park dedication at <br />the time of subdivision/new development. <br /> Per the ordinance, it shall be presumed that a reasonable amount of land has been <br />dedicated for parks and playgrounds if the developer dedicates at least ten percent of <br />the total land in the proposed subdivision. The City is allowed to determine whether <br />a cash payment in lieu of land dedication is appropriate, and to make a further <br />determination on the reasonableness of the dedication (whether more or less land is <br />needed based on the proposed development). <br /> Land proposed for park dedication must be useable in order to fulfill park dedication <br />requirements. <br /> For this development, the applicants are proposing the following: <br /> Pulte: land will be dedicated for a public park in the SE corner of 8th Avenue <br />NW and 7th Street NW. The amount of land to be dedicated is 0.53 acres which <br />would be 11.7% of Pulte’s overall land area. This would exceed the 10% land <br />dedication threshold for the townhome portion of the development. <br /> Dominium: Dominium is proposing to pay for and construct a tot lot within the <br />land area being dedicated by Pulte at an estimated cost of $100,000. The final <br />cost of the improvements would be deducted from the overall cash-in-lieu of <br />land requirement called for by the City’s fee schedule. <br /> 204 senior rentals x $1,825 = $372,300 <br /> 154 workforce rentals x $1,825 = $286,525 <br />Total required cash-in-lieu payment = $658,825 <br /> Less amount paid for park improvements ≈ $100,000 <br /> Anticipated park dedication fee ≈ $558,825 <br /> Prior to the dedication of the required property, the subdivider shall provide the City <br />with an acceptable title opinion or title insurance policy addressed to the City that <br />insures the title and the City's proposed interest in the property. <br /> The subdivider must transfer good and marketable title to the City, free and clear of <br />any mortgages, liens, encumbrances or assessments, except easements or minor <br />imperfections of title acceptable to the City. <br /> If the land is not formally dedicated to the City with the final plat, the subdivider <br />shall record all deeds for conveyance of the property to the City at the same time as <br />the final plat or other appropriate division documents are filed. <br /> <br />
