SUP Amendment and Site Plan Review; Murlowski Properties Inc. <br />Planning Commission Report; 7-16-19 <br /> <br /> <br />Page 7 <br />Special Use Permit Review <br />In General: All site plan changes within the Environmental Constraint Overlay Area require an <br />SUP amendment. <br /> <br />SUP Standards <br />Review: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Issuance of an SUP amendment requires an analysis of the proposed use against the <br />specific review criteria established in code. Staff has reviewed the City’s criteria for <br />special use permits, and we offer the following analysis for consideration: <br /> <br />General review Criteria (Section 8-130): <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />Staff Comment: The proposed change in location of the rubble pile will not <br />endanger the public or impact general welfare. The large earthen berm on the <br />western edge of the site coupled with the sound mitigation wall has effectively <br />addressed sound concerns. No complaints about the site have been recorded by <br />911, and no complaints have been received by the code compliance official dating <br />back to at least 2015. As Wenck has updated the sound mitigation plan to certify <br />the proposed changes will continue to protect against noise pollution, we find this <br />criteria to be met. <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />Staff Comment: The main concerns with this proposal center on noise pollution, <br />and stormwater management. Noise should not be a problem according to the <br />Wenck sound management plan update, and stormwater can be successfully <br />treated provided all engineering conditions of approval are met. Accordingly, <br />staff finds this criteria to be met. <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />Staff Comment: The proposed changes will have no impact on the development <br />of surrounding property. On the contrary, movement of the rubble pile to the <br />proposed location will (over-time) result in more usable land for future uses on <br />this site as the rubble will compact the soil to improve its usability which is a win- <br />win for the City and current land owner. <br /> <br />
