SUP Amendment and Site Plan Review; Murlowski Properties Inc. <br />Planning Commission Report; 7-16-19 <br /> <br /> <br />Page 11 <br />Commission <br />Options: <br />The Planning Commission has the following options: <br />A) RECOMMEND APPROVAL OF THE SUP AMENDMENT based on the <br />applicant’s submittals and findings of fact. <br />B) RECOMMEND DENIAL OF THE SUP AMENDMENT based on the <br />applicant’s submittals and findings of fact. <br />C) TABLE THE ITEM and request additional information. <br />Based on an application date of 6/14/19, the 60-day review period for this <br />application expires on 8/13/2018. This deadline can be extended an additional 60 <br />days if more time is necessary. <br /> <br />Template Denial <br />Motion: <br />(not recommended) <br /> “I move that we recommend the City Council deny the requested special use <br />permit amendment based on the following findings of fact:” <br />o (provide findings to support your conclusion) <br /> <br />Template Approval <br />Motion: <br />RECOMMENDED <br /> “I move we recommend the City Council approve the requested Special Use <br />Permit amendment based on the findings of fact listed on pages 11 & 12 of <br />the report subject to the conditions listed on page 12 as may have been <br />amended here tonight.” <br /> <br />Suggested Findings <br />of Fact: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />1. The subject property is guided for light industrial uses, and the proposed use <br />(aggregate crushing and recycling operation) was previously approved for <br />this site since 2010. <br />2. Under the current SUPs, the use has not generated any official complaints <br />regarding noise, dust, or odors since the latest SUP update in 2015. <br />3. Continued operation of an aggregate crushing and recycling operation in a <br />slightly modified location will not be detrimental to or endanger the public <br />health, safety, morals, comfort, or general welfare of the community. <br />4. The proposed new location for rubble pile storage will not impact the use and <br />enjoyment of the subject and surrounding properties provided existing <br />conditions regarding site maintenance are adhered to. <br />5. The proposed rubble storage area will be of equal size to the rubble storage <br />area it is replacing (≈ 4 acres)
