site use changes. Flow from this pipe appears to be compromised from previous settlement of
landfill materials. Based on this the NWL/HWL of Rush Lake can be affected, and the pipe is
holding debris. The pipe is a 36” diameter storm sewer pipe that serves as the outlet of Rush
Lake that was installed in 1963. It runs from Rush Lake to the north through the Belair property to
the northerly City Limits, and it then changes direction to the west and outlets to Rice Creek. The
City has concerns about the placement of additional material over this pipeline causing the pipes
to collapse due to the increased loading. Belair has indicated a willingness to install a new outlet
pipe at a location that is not below the proposed piles. Plans for a new pipe must be shown (with
the preferred location being the SW corner of the site). Easements over City Storm Sewer need
to be shown.

9. Belair owns the RR property, but does not operate it. MN Commercial RR, the operator, needs to
provide comments or a letter of support indicating that the proposed changes do not affect their
ability to operate the RR under the Federal rules/guidelines.

10. The sound wall extension design must be approved by a structural engineer.
