Page 1 of 7 <br /> <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AMENDMENT AUTHORIZING SITE PLAN CHANGES TO RELOCATE <br />ALLOWED RUBBLE PILES AT 2200 OLD HIGHWAY 8 <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Murlowski Properties Inc, owns and operates the property located at 2200 Old <br />Highway 8 legally described as in Exhibit A; and <br /> <br />WHEREAS, Murlowski Properties Inc (the “Applicant”) made application to the City on 6/14/19 <br />for a Special Use Permit (SUP) amendment to authorize relocating previously approved rubble piles <br />to a new storage location on the Murlowski Properties Inc site; and <br /> <br />WHEREAS, the proposed rubble pile relocation would include the extension of a previously <br />approved sound mitigation wall and continued compliance to previous conditions of approval <br />including pile coverage area, pile heights, etc; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on July 16, 2019; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the July 16th meeting <br />and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on July 16th based on <br />the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on July 23rd, 2019, the recommendations of the Planning <br />Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence <br />available to the Council. <br /> <br /> <br /> <br /> <br />
