Page 1 of 11 <br /> <br /> <br /> <br />THE CITY OF NEW BRIGHTON <br />RAMSEY COUNTY, MINNESOTA <br />ORDINANCE NO. 867 1 <br />AN ORDINANCE UPDATING CODE LANGUAGE ON ZONING 2 <br />ENFORCEMENT AND OTHER ENFORCEMENT ACTIVITIES RELATING 3 <br />TO THE CITY’S MOST COMMON COMPLAINTS AND ISSUES 4 <br /> 5 <br /> 6 <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS: 7 <br />Section 1. The City Council of the City of New Brighton hereby amends City Code, Chapter 17 8 <br />Nuisances, Section 17-2, Health Nuisances, as follows: 9 <br />The introductory paragraph and subsections (1) through (8) are restated and incorporated 10 <br />herein unchanged. 11 <br />(9) Structure Unfit for Human Occupancy. A structure is unfit for human occupancy 12 <br />whenever the Building Official or Code Enforcement Officer finds that such structure is 13 <br />unsafe, unlawful or, because of the degree to which the structure is in disrepair or lacks 14 <br />maintenance, is insanitary, vermin or rat infested, contains filth and contamination, or lacks 15 <br />ventilation, illumination, sanitary or heating facilities or other essential equipment required 16 <br />by the City Code, or because the location of the structure constitutes a hazard to the 17 <br />occupants of the structure or to the public. 18 <br />(9) (10) Other Acts. All other acts, omissions of acts, occupations, and uses of property 19 <br />which are deemed by the Health Officer to be a menace to the health of the inhabitants of 20 <br />the City or a considerable number thereof. 21 <br />Section 2. The City Council of the City of New Brighton hereby amends City Code, Chapter 17 22 <br />Nuisances, Section 17-5, Enforcement, as follows: 23 <br />The introductory paragraph and subsections (1) through (4) are restated and incorporated 24 <br />herein unchanged. 25 <br />(5) Structure Unfit for Human Occupancy. In the event a home is determined to be unfit 26 <br />for human occupancy, either the Building Official or Code Enforcement Officer may 27 <br />exercise the City’s authority to deem the home unsafe in accordance with Minnesota 28 <br />Building Code provision 1300.0180. 29
