The City Council of the City of New Brighton hereby repeals City Code, Chapter 17 30 <br />Nuisances, Section 17-6 through 17-10 in their entirety, and adopts the following 31 <br />language: 32 <br />17-6. Nuisance Abatement Procedure 33 <br />(1) Notice. 34 <br />(A) Whenever the City determines that a public nuisance is being maintained or 35 <br />exists on a premises in the City, the Building Official or their designated 36 <br />representative may abate the nuisance after providing written notice to the 37 <br />affected record property owner. 38 <br />(B) The notice shall be given to the affected record property owner by U.S. Mail 39 <br />or personal delivery. Refusal by the recipient to accept the notice shall not 40 <br />constitute a defense that the notice was not received. If the record owner is 41 <br />not able to be found, the City shall attach a copy of the notice or a door hanger 42 <br />with the same information to the main entrance door of the principal structure 43 <br />on the property. The notice shall state the following information at a 44 <br />minimum: 45 <br />(i) The date; 46 <br />(ii) The address or legal description of the property; 47 <br />(iii) A description of the nuisance and the section or sections of the City Code 48 <br />which was/were violated; 49 <br />(iv) The steps to be taken in order to abate the nuisance; 50 <br />(v) The date by which the nuisance must be abated (grass and weed 51 <br />violations must be abated within five calendar days from the date of the 52 <br />notice); 53 <br />(vi) That if the nuisance is not abated by the date stated, the City will abate 54 <br />the nuisance and the costs incurred by the City will be charged, and if left 55 <br />unpaid, will be certified to the county auditor for collection with property 56 <br />taxes or specially assessed; 57 <br />(vii) That the recipient has the right to appeal, in writing, the notice to the City 58 <br />Council and the date by which such an appeal must be filed; and 59 <br />(viii) A description of the penalties that may apply if the condition is not 60 <br />corrected. 61
