This section is adopted pursuant to Minnesota Statutes Sections 415.01, 100 <br />366.011, and 366.012. 101 <br />(2) Charges for emergency services; collection. The City may impose a reasonable 102 <br />service charge for emergency services, including fire, rescue, medical, and related 103 <br />services provided by the City or contracted for by the City. If the service charge 104 <br />remains unpaid for 30 days after a notice of delinquency is sent to the recipient of 105 <br />the service or the recipient’s representative or estate, the City or its contractor on 106 <br />behalf of the City may use any lawful means allowed to a private party for 107 <br />collection of an unsecured delinquent debt. The City may also use the authority of 108 <br />Section 17-8(3) to collect unpaid service charges of this kind from delinquent 109 <br />recipients of services who are owners of taxable property in the City, or areas 110 <br />served by the City for emergency services. 111 <br />The powers conferred by this section are in addition and supplemental to the 112 <br />powers conferred by any other law for a City to impose a service charge or 113 <br />assessment for a service provided by the City or contracted for by the City. 114 <br />(3) Collection of unpaid service charges and fees. If the City is authorized to impose 115 <br />a service charge or fee on the owner, lessee, or occupant of property, or any of 116 <br />them, for a governmental service provided by the City, the City may certify to the 117 <br />county auditor, on or before October 15th for each year, an y unpaid service charges 118 <br />or fees which shall then be collected together with property taxes levied against the 119 <br />property. A charge or fee may be certified to the auditor only if, on or before 120 <br />September 15th, the City has given written notice to the propert y owner of its 121 <br />intention to certify the charge or fee to the auditor. The service charges or fees 122 <br />shall be subject to the same penalties, interest, and other conditions provided for the 123 <br />collection of property taxes.
